Since the beginning of the war, numerous amendments have been made to the current legislation, particularly regarding criminal offenses committed by members of the Armed Forces of Ukraine.<\/p>\n<p>Remember: servicemembers are not exempt from criminal liability during martial law. If criminal proceedings have been initiated against you, you should immediately seek qualified legal assistance from an <a href=\"https:\/\/arou.ua\/en\/komanda\/\">attorney of the Legal and Real Estate Association of Ukraine \u201cAROU\u201d<\/a> to receive advice on whether such actions were lawful.<\/p>\n<h2>The most common military criminal offenses include:<\/h2>\n<ul>\n<li><i>open refusal to obey a commander\u2019s order<\/i><\/li>\n<li><i>unauthorized abandonment of a place of service or military unit<\/i><\/li>\n<li><i>desertion<\/i><\/li>\n<li><i>theft or misappropriation of weapons by servicemembers<\/i><\/li>\n<li><i>abuse of authority or official powers<\/i><\/li>\n<\/ul>\n<p>After the start of the full-scale invasion of Russian troops into Ukraine, men of mobilization age \u2014 whether voluntarily or upon receiving a summons \u2014 joined the Armed Forces of Ukraine and other military units. However, many of those who ended up on the front line faced extremely harsh physical and psychological challenges as well as strict discipline. Because of this, some servicemembers choose to leave their military unit without authorization (AWOL).<\/p>\n<p>Unauthorized abandonment of a military unit (AWOL) is a serious violation of military law.<\/p>\n<p>Sometimes servicemembers find themselves in difficult situations where they cannot return from medical treatment on time or report to their unit. This is only one possible scenario. For this reason, each case requires individual analysis.<\/p>\n<p>First, it is important to distinguish between desertion and unauthorized abandonment of a military unit (AWOL). Although these terms share similarities, they are not identical.<\/p>\n<h3>Criminal liability for desertion is defined in Article 408 of the Criminal Code of Ukraine and includes the following actions:<\/h3>\n<ul>\n<li><i>Changing the place of service without approval from military command<\/i><\/li>\n<li><i>Failure to appear for military duty as required<\/i><\/li>\n<li><i>Failure to respond to a military call-up<\/i><\/li>\n<\/ul>\n<p>The main difference lies in the intention. Desertion implies a servicemember\u2019s deliberate intention not to return to military duties, without limitation on time.
