The employer may impose disciplinary sanctions on an employee for violating labor discipline. The procedure for applying such sanctions is governed by Article 149 of the Labor Code of Ukraine. However, there are cases when disciplinary sanctions are imposed unlawfully or with procedural violations. In such situations, the employee has the right to challenge the sanction under Article 150 of the Labor Code.<\/p>\n<h3>Where to file a complaint?<\/h3>\n<p>Challenging disciplinary sanctions falls under the jurisdiction of two bodies: <strong>labor dispute commissions<\/strong> at city or district courts and directly <strong>the courts<\/strong> (Article 221 of the Labor Code). The employee must file a complaint within three months from the date they became aware of the sanction.<\/p>\n<h3>Complaint review process<\/h3>\n<ol>\n<li><strong>The labor dispute commission<\/strong> checks:\n<ul>\n<li>The legality of the sanction.<\/li>\n<li>Whether the severity of the offense matches the imposed sanction.<\/li>\n<\/ul>\n<p>After reviewing the complaint, the commission may revoke the unlawful sanction or suggest replacing it with a different penalty if the severity of the offense does not justify the punishment.<\/li>\n<li><strong>Court review<\/strong>: when filing a lawsuit, the court will thoroughly examine the legitimacy of the sanction, regardless of the employee\u2019s request.
