Growing interest in solar energy and the problem of debt<\/strong><\/h3>\n

In recent years, Ukraine has seen a growing interest in renewable energy, particularly in solar power plants (SPPs). The green tariff support program has become an important stimulus for the sector’s development. However, due to economic challenges and changes in energy sector funding, the state has accumulated significant debts to electricity producers under the green tariff.<\/p>\n

This article provides a legal analysis of the debt issue, an overview of the regulatory framework, and recommendations for debt recovery.<\/p>\n

Assessment of the electricity purchase agreement under the green tariff<\/strong><\/h3>\n

The electricity purchase agreement under the green tariff is concluded between the electricity producer (SPP owner) and the SE “Guaranteed Buyer”. It is bilateral, compensated, and time-limited. Key provisions of the agreement include:<\/p>\n

    Obligation of the SE “Guaranteed Buyer” to purchase electricity at the set tariff<\/p>\n<\/li>\n

  • \n

    Obligation of the state to ensure appropriate funding for these payments<\/p>\n<\/li>\n

      Civil Protection Code regarding investor rights in critical situations<\/p>\n<\/li>\n<\/ul>\n

      According to current legislation, the state must make payments in accordance with signed agreements. At the same time, financial difficulties and budget non-fulfillment lead to the accumulation of debts to electricity producers.<\/p>\n

      Determining the grounds for debt recovery claims<\/strong><\/h3>\n

      Legal grounds for debt collection may include:<\/p>\n

        Breach of contract \u2013 failure to pay for delivered electricity<\/p>\n<\/li>\n

        Improper performance by the state \u2013 the debts of the SE may be viewed as state budget liabilities<\/p>\n<\/li>\n

        Court practice \u2013 existing precedents of court rulings in favor of SPP owners<\/p>\n<\/li>\n

        European law and Ukraine\u2019s international obligations \u2013 possible application of international law for foreign investors<\/p>\n<\/li>\n<\/ul>\n

        Conclusions and recommendations<\/strong><\/h3>\n

        Solar power plant owners facing debt issues may use the following protection mechanisms:<\/p>\n

          Out-of-court settlement \u2013 sending official claims and negotiating with the SE<\/p>\n<\/li>\n

          Judicial proceedings \u2013 filing lawsuits in Ukrainian commercial courts<\/p>\n<\/li>\n

          International arbitration \u2013 for foreign investors, cases can be considered in international courts<\/p>\n<\/li>\n

        • \n

          Engaging lawyers and legal firms \u2013 for effective case management and negotiations<\/p>\n<\/li>\n<\/ul>\n
