On April 11, 2024, the Verkhovna Rada of Ukraine adopted a new Mobilization Law, which introduces important changes regarding individuals with certain health limitations.
According to this new law, persons with disabilities of all groups are now exempt from mobilization. Additionally, those who are recognized as unfit for military service due to health conditions are granted a deferral from military service for a period of 6 to 12 months. However, after this period, they must undergo a repeated medical examination to reassess their health condition.
These changes aim to ensure a more effective and fair mobilization mechanism, taking into account the individual characteristics and needs of every citizen.
The Law Firm provides consultations to military-liable individuals regarding health conditions during mobilization. This convenient service allows you to determine which category you fall under during mobilization and whether you have the right to a deferral or may be removed from military registration.
Based on the decision of the Military Medical Commission (MMC), individuals recognized as unfit for military service must be removed from military registration. Their military registration document receives the corresponding mark, and they are issued an MMC certificate confirming unfitness for military service. After this, such a person is no longer considered military-liable and is exempt from military duties.
According to the law, every citizen with military obligations has the right to a justified and fair determination regarding their fitness for service. They may provide additional medical documents concerning any illnesses or seek an opinion from another medical institution. All such actions should be carried out during the MMC process to confirm their unfitness status.
If you have strong grounds to believe that the MMC conclusion is unlawful, you may contact us — and we will challenge it in court.
Health status during mobilization is a truly important and serious matter that requires well-considered and decisive action. It is best to rely on a military lawyer who will explain all the nuances. This is especially important for individuals who cannot move independently and have difficulty visiting the necessary institutions to collect documents. In such cases, we will handle everything for you!
