A road traffic accident is always a stressful situation, but the driver’s correct actions can significantly affect the outcome. Whether you are at fault or a victim, it is important to know how to act at the scene to protect your rights and avoid legal problems.
Lawyers at the “Advocacy and Real Estate Association of Ukraine” have prepared a detailed step-by-step guide to help you act confidently and according to the law.
1. Stop and turn on hazard lights
No matter the severity of the accident, stop and turn on your hazard lights. If possible, place the warning triangle:
-
In populated areas – at least 25 m from your car
-
Outside populated areas – at least 40 m away
2. Make sure there are no injured parties
Check yourself, your passengers, and others involved. If anyone is injured, call an ambulance at 103.
3. Call the police
Dial 102 in the following cases:
-
There are injured or deceased persons
-
Vehicles or other property are damaged
-
Drivers cannot agree on who is at fault
-
One of the drivers is under the influence
-
The at-fault driver is trying to flee the scene
If the accident is minor and all parties agree, you may use the European Accident Statement (without calling the police).
4. Take photos and videos
Document the scene, damage to the vehicles, road signs, traffic lights, and markings. This will help in court or when dealing with insurance.
5. Exchange information with other drivers
Write down:
-
Full names, license plates, contact information
-
Insurance policy number of the other driver
6. Do not admit fault at the scene
Avoid making spontaneous comments or admitting fault without speaking to a lawyer. Anything you say may be used against you.
7. Contact a lawyer
To avoid legal risks, seek legal advice as soon as possible. Lawyers at AROU will help:
-
Assess the legal consequences of the accident
-
Defend your interests with police, insurance companies, and in court
-
Appeal any unfair decisions
A traffic accident is unpleasant, but not always critical. By following proper procedures and consulting professionals, you can minimize risks and protect your rights.
