When to Appeal a Police Report After an Accident

A road traffic accident (RTA) is always stressful, and a police report can cause even more discomfort if you disagree with its content. Errors or subjective interpretations in the report may lead to serious consequences: fines, loss of driving privileges, court proceedings, or even criminal liability.
The lawyers of the “Advocacy and Real Estate Association of Ukraine” will help you understand when and how to appeal a police report correctly.

1. When should a report be appealed

Challenging a police report is necessary in the following cases:

1.1. Incorrect determination of fault in the accident

If you disagree with the police’s conclusions and believe you were wrongly found guilty, you should act:

  • The report may incorrectly describe the circumstances of the accident

  • Witness statements or dashcam footage were ignored

  • Police overlooked key evidence proving your innocence

1.2. Formal errors in the report

Any inaccuracies or missing required information in the report can be grounds for appeal:

  • Your personal data or that of the other party is incorrect

  • Accident circumstances are inaccurately described

  • Missing signature of the police officer or your own (if you weren’t shown the document)

1.3. Violation of procedures

Police officers must act according to established procedures. If they deviate from the protocol, this can justify an appeal. For example:

  • You were not informed of your rights

  • Witnesses weren’t involved or all evidence wasn’t reviewed

  • Conclusions were based on assumptions without sufficient proof

1.4. Disagreement with expert findings

If an assessment of the vehicle or driver is conducted and its results are incorrect, the report can be appealed. For example:

  • You were sober, but the alcohol test showed a false positive

  • Vehicle damage assessment was biased or poorly done

2. How to appeal a police report

Appealing a police report requires legal expertise and clear arguments. The procedure includes:

2.1. Review of the report

A lawyer thoroughly reviews the document, identifies mistakes and violations, and gathers supporting evidence.

2.2. Filing a court complaint

The appeal must be filed within 10 days of the report’s issuance. It’s essential to prepare all documents correctly and justify your position.

2.3. Court proceedings

In court, your lawyer:

  • Represents your interests

  • Provides evidence and witness statements to prove the report is invalid

  • Challenges the police findings if they don’t match the actual situation

3. Why consult a lawyer

Legal support significantly increases your chances of successfully appealing a police report. A lawyer will help you:

  • Submit all documents on time

  • Build a solid defense strategy

  • Avoid fines, license suspension, or other penalties

The lawyers of the “Advocacy and Real Estate Association of Ukraine” have extensive experience in accident-related cases and are ready to assist you in difficult situations.
