What Are a Driver’s Rights in Case of a Traffic Accident

A road traffic accident is always an unexpected and stressful situation, where it is important to stay calm and know your rights. Whether you are the at-fault party or the victim, understanding your rights will help you avoid legal mistakes, receive fair compensation, and protect yourself from unlawful actions by other participants or law enforcement.
The lawyers of the “Advocacy and Real Estate Association of Ukraine” have prepared a clear overview of a driver’s rights in case of an accident.

1. The right not to admit guilt without evidence

Police or other participants may insist you are at fault, but you have the full right to:

  • Not admit guilt at the scene

  • Refuse to sign the report if you disagree with its content

  • Insist on an objective investigation

Any admission of guilt without proper analysis may complicate the protection of your rights.

2. The right to legal assistance

A driver has the right to engage a lawyer at any stage of the process, including:

  • When the police are drawing up the report

  • During an expert examination or court proceedings

  • For advice on dealing with the insurance company

A lawyer will help avoid legal mistakes, appeal unfair decisions, and protect your interests.

3. The right to request all necessary documents

At the accident scene, police are required to prepare all documents in accordance with the law. You have the right to request:

  • A copy of the administrative offense report (if issued)

  • A diagram of the accident with all relevant details

  • Contact and insurance details of other involved parties

If there are inaccuracies or errors in the documents, they can be appealed in court.

4. The right to compensation

If you are the victim in the accident, you have the right to claim:

  • Reimbursement for vehicle repair expenses

  • Compensation for medical treatment in case of injuries

  • Payment for moral damages

If the insurance company refuses to pay, a lawyer can help you enforce your rights.

5. The right to an independent examination

If you disagree with the conclusions of an expert assessment by the police or insurance company, you have the right to:

  • Order an independent damage assessment

  • Challenge the official results in court

Legal support during the assessment ensures its objectivity.

6. The right to appeal fines and reports

If you believe the police report was drafted with violations or you were wrongfully found guilty, you have the right to:

  • Appeal the fine or decision in court

  • Request a review of the case

  • Present additional evidence in your favor

You can appeal an administrative offense ruling within 10 days of its issuance.

7. Why consult a lawyer

In complex situations following an accident, legal assistance is a key factor in protecting your rights. A lawyer will help you:

  • Interact effectively with police and insurers

  • Appeal unjust fines or court rulings

  • Secure compensation for your losses

The lawyers at the “Advocacy and Real Estate Association of Ukraine” have many years of experience in traffic accident cases and are ready to assist you in any situation.
