Can You Get Compensation if the At-Fault Driver Has No Insurance

A traffic accident is always an unpleasant event, but it becomes even more complicated if the at-fault driver does not have mandatory civil liability insurance (MTPL). In such cases, victims often wonder: is it possible to receive any compensation, and who is responsible for covering the losses?

The lawyers of the “Advocacy and Real Estate Association of Ukraine” explain what options the injured party has and how to act properly to protect their interests.

Is insurance mandatory for drivers in Ukraine

According to current Ukrainian legislation, every vehicle owner must have MTPL insurance. This policy guarantees that in the event of a traffic accident, damages to the injured party will be covered by the at-fault driver’s insurance company.

However, many drivers still operate vehicles without such insurance. In these cases, compensation for damages falls directly on the at-fault driver. This complicates the process, but receiving compensation is legally possible.

What are the options if the at-fault driver has no insurance

Option 1: Voluntary compensation
If the driver admits guilt and agrees to pay damages without going to court, the parties may sign a settlement agreement. A lawyer will help draft the agreement properly to avoid legal issues later.

Option 2: Court proceedings
If the driver refuses to pay voluntarily, the victim has the right to file a lawsuit. The court may order the driver to pay for:

  • car repair costs

  • vehicle evacuation expenses

  • medical treatment and rehabilitation (if injuries occurred)

  • moral damages

Professional preparation of the claim and evidence increases the chances of a favorable outcome.

Option 3: Compensation from the MTIBU
If the at-fault driver does not have MTPL insurance, but the victim holds a valid MTPL or CASCO policy, some categories of damages may be compensated by the Motor (Transport) Insurance Bureau of Ukraine (MTIBU). This includes:

  • compensation for injuries or death

  • in some cases — property damage

A lawyer will help prepare and submit all required documents to the MTIBU to increase the chance of success.

Why it’s important to consult a lawyer immediately after an accident

Lack of insurance on the part of the at-fault driver makes the situation more complex than a standard insurance case. It is crucial to properly prepare documents, gather evidence, and present clear demands and arguments. An experienced lawyer will help:

  • conduct legal analysis and suggest the optimal strategy

  • prepare claims and demands for the at-fault driver

  • collect evidence (expert reports, witness statements, photographs, etc.)

  • represent your interests in court and when contacting the MTIBU

  • ensure enforcement of the court decision if ruled in your favor
