How to Legally Transfer a Vehicle to the Military Without Fines? Legal Recommendations

During wartime, thousands of volunteers and charities donate vehicles to the Ukrainian Armed Forces. However, legal or customs errors can lead to fines, vehicle seizures, or invalidation of the transfer.

The Legal and Real Estate Association of Ukraine provides step-by-step legal guidance to ensure safe and lawful vehicle transfer.

Three Key Rules:

  • Comply with customs clearance regulations

  • Properly draft and sign legal documents

  • Register the transfer with the military unit

Step 1. Vehicle Import

  • Declare military or humanitarian purpose at customs

  • Provide a letter-request from a military unit or NGO

  • Vehicles brought as aid must not be used for private or commercial use

Step 2. Legal Documentation

Option 1: Gift Agreement (Recommended)
Best for permanent donation

Must include:

  • Full legal details of both parties

  • Purpose of transfer for military use

  • Attachments: title, customs forms

  • Transfer acceptance certificate

Option 2: Free Use Agreement
Use without changing ownership

Drawback: No compensation if the vehicle is damaged or destroyed

Step 3. Transfer to the Military

  • Vehicle is officially received and registered

  • Responsibility shifts to the military

  • Keep all paperwork as legal proof

How to Avoid Legal Risks?

  • Don’t transfer vehicles without official documents

  • Never use humanitarian vehicles for private needs

  • Seek legal consultation before importing

  • Follow Ukrainian laws during documentation
