War and mobilization have united a significant part of the population with the Armed Forces of Ukraine and other military formations, which has led to an increased demand for legal assistance in military matters. When should an attorney request be submitted?
An attorney request is an effective tool for gathering evidence and preparing for further legal actions. Its advantage lies in its simplicity: an experienced lawyer needs less than an hour to prepare and send such a request.
However, processing an attorney request, as well as preparing and sending a response, may require significantly more time and effort, involving multiple departments of a military unit, including personnel, logistics, finance, and legal divisions.
Inaccuracy or incompleteness in the first attorney request that requires sending an additional one is a sign of serious incompetence and may become grounds for disciplinary liability. Repeated attorney requests are acceptable only when the lawyer discovers new circumstances requiring clarification that were previously unknown and could not have been foreseen at the time of sending the first request.
Where should an attorney request be sent?
Military units are generally legal entities, but their data is not displayed in public state registers. During wartime, information about the location of military units is classified as a state secret — however, this does not create practical difficulties.
A request is sent to the conditional name of the military unit, which is usually known to the client or lawyer in disputed situations. On the envelope, it is sufficient to indicate the conditional name (for example, Military Unit A0000) and the locality (city/town/village) where the unit is located, if such information is available. It is also advisable to send an attorney request as a registered valuable letter with an inventory of the contents. In case of a dispute, this will serve as evidence that the attorney request was indeed sent.
