Ownership rights to a land plot may be confirmed by various legal documents; however, situations often arise where it becomes necessary to prove such rights through administrative or court procedures. In this article, we will review which documents serve as proof of ownership, what to do if such documents are lost or unavailable, and which legal mechanisms may be used to confirm land ownership rights.
1. Documents Confirming Ownership Rights
The main evidence confirming ownership of a land plot includes:
- State act confirming ownership rights to land (issued before 2013);
- Extract from the State Register of Property Rights to Real Estate;
- Sale and purchase agreement, gift agreement, exchange agreement, or lifetime maintenance agreement;
- Court decision that has entered into legal force;
- Inheritance documents (certificate of inheritance rights);
- Acts of local self-government bodies or state authorities regarding transfer of land into ownership.
2. What Should You Do If Documents Are Lost or Missing?
If documents confirming ownership rights have been lost or improperly оформлені, it is necessary to:
- Obtain a duplicate document from the relevant authority (notary, StateGeoCadastre, local council, archive).
- If the land plot was obtained before 2013 but was not entered into the State Register, apply to a state registrar to register ownership rights.
- If the documents cannot be restored or there is a dispute regarding ownership rights, apply to court.
3. Proving Ownership Rights in Court
If your rights to the land are disputed or ownership must be confirmed in court, it is important to prepare:
- Contractual documents confirming acquisition of ownership rights.
- Decisions of authorities regarding transfer of the land plot into ownership.
- Cadastral and technical documentation (extract from the StateGeoCadastre, cadastral number, boundary plan).
- Testimony from persons who can confirm your possession of the land plot over a certain period of time.
- Expert conclusions (if there is a dispute regarding land boundaries).
4. Common Mistakes Made by Landowners
- Absence of ownership registration in the State Register.
- Use of a land plot without proper documentation.
- Failure to update information in official registers.
- Insufficient attention to preserving original documents.
