When to Prepare Your Documents

When customs or other state authorities impose a fine, it does not automatically mean the fine is lawful or final. Many fines can be successfully appealed if you act correctly and have the necessary documents.

The legal team at the Legal and Real Estate Association of Ukraine has prepared a detailed list of documents to help you protect your rights and cancel an unlawful fine.

Basic Document Package for Appealing a Fine

1. Copy of the Fine Decision

This is the main document confirming that a fine has been imposed. It must include:

• The legal basis for the fine (what specific violation is being alleged)

• Reference to the relevant law or article

• Payment deadline and information about the appeal process

Important: if you did not receive the decision or it contains procedural errors, this alone may be grounds for cancellation.

2. Customs Declaration (if the fine concerns import of goods or vehicles)

This document proves that customs procedures were followed.

What to check:

• Do the product or vehicle details match the actual data

• Are all signatures and stamps present

• Are there any technical errors in the paperwork

3. Documents Confirming Intended Use of Property

If you imported a vehicle or humanitarian aid for the Armed Forces:

• A request letter from a military unit or volunteer organization

• A donation or free transfer agreement

• An act of transfer and acceptance of property

4. Evidence of No Violation

If the fine was issued by mistake or without proper grounds, include:

• Witness statements (from volunteers, military personnel, etc.)

• Photo and video evidence

• Supporting documents: contracts, reports, delivery notes

5. Complaint (Administrative or Legal Claim)

This is the key legal document where you:

• Describe the situation

• Provide legal justification against the fine

• Include references to applicable laws

• Clearly request the cancellation of the fine and list evidence

How to Format Your Documents Properly

• Verify all names, dates, and document numbers

• Sign and notarize documents if required

• Keep copies of all submitted materials

• Respect submission deadlines – usually 10–30 days from the date of the decision
