Blocking tax invoices is one of the most painful issues for Ukrainian businesses. This is especially true for industries with large document flows and high transaction volumes, such as construction, real estate, and wholesale trade. Repeated blocking of tax invoices even after successful appeals is not just a bureaucratic inconvenience — it creates serious financial and reputational risks.
In this article, lawyers of the Ukrainian Bar and Real Estate Association outline practical mechanisms for preventing repeated blocking of tax invoices.
1. A Systematic Approach to the Company’s Tax Reputation
First of all, it is important to understand that the risk of invoice blocking is directly linked to the taxpayer’s “tax profile.” To avoid repeated blocking, businesses should:
- Maintain a positive tax history: no tax debt, timely reporting, and sufficient tax burden.
- Ensure compliance with the State Tax Service risk criteria, especially regarding business activity codes, suppliers, and salary levels.
- Regularly monitor whether the company appears on the list of risky taxpayers through the taxpayer’s electronic cabinet or the State Tax Service website.
2. Proper Justification of Primary Documents
One of the most common reasons for blocking is formal or substantive deficiencies in documents confirming the reality of business transactions.
In particular:
- Contracts, invoices, delivery notes, and transport documents should be properly prepared and preferably stored digitally.
- Data in supporting documents must match the tax invoice information.
- The actual supply of goods or services should be confirmed by logistics, warehouse accounting, photo evidence, etc.
3. Counterparty Verification — A High-Risk Area
Tax invoices are often blocked because a counterparty is considered risky, even if your business operates honestly.

- Checking counterparties before entering into agreements using State Tax Service resources, Opendatabot, YouControl, etc.
- Recording the process of selecting counterparties (commercial offers, correspondence, internal protocols).
- Avoiding counterparties with signs of fictitious activity: inactive sole proprietors, lack of turnover, mass registration addresses, etc.
4. Monitoring the SMKOR System and Quick Response

- Regularly monitor risk notifications in the system.
- If an invoice is blocked, immediately submit a reasoned written explanation with supporting documents (form J/F1312603).

5. Legal Structuring of Transactions
Certain transactions, especially in real estate (leases, commercial property sales, land transactions), carry increased VAT risks. In such cases:

- Avoid non-standard transactions without legal support, such as lease right transfers or barter arrangements.
6. Court Protection and Preventive Strategies
If a tax invoice remains blocked after explanations are submitted, court proceedings may become necessary. However:
- Avoid template appeals. Courts pay attention to the quality of arguments and the reality of the transaction.
- Preserve evidence of actual supply (acts, photos, logistics, payment confirmations).
- Legal support from the first blocking stage significantly increases the chances of preventing repeated issues.
Preventing repeated tax invoice blocking is not a one-time measure but an ongoing process involving accounting, legal support, and internal control. For businesses in real estate, trade, and services, it is especially important to build legally secure business processes that reduce tax risks.
