The issue of tax and other inspections without prior notice is one of the most relevant concerns for businesses in Ukraine. This is especially important for lawyers, real estate professionals, and other business entities seeking to protect their operations from unexpected inspections. In this article, we will review the circumstances under which inspections may be carried out without prior notice and what rights businesses have in such situations.
Legal Grounds for Conducting Inspections
The general procedure for inspections is regulated by the Tax Code of Ukraine, the Law of Ukraine “On the Basic Principles of State Supervision (Control) in the Sphere of Economic Activity,” and other regulations. According to these rules, inspections are divided into:

3. In Emergency Situations

- Right to review documents. Inspectors must provide official identification and documents confirming their authority.
- Right to legal representation. Businesses have the right to involve a lawyer or another representative during the inspection.
- Recording the inspection process. It is advisable to document inspectors’ actions through photos, videos, or written records to protect your rights.
- Preparation of an inspection report. At the end of the inspection, an official report is prepared, which the business has the right to review and challenge if necessary.

- Always verify inspectors’ documents. Do not allow unauthorized individuals to conduct inspections.
