Illegal Use of Your Land Plot: How to Protect Your Rights

Protection of landowners’ rights is an important legal issue, especially in cases where third parties use land without proper legal grounds or without the owner’s consent. Illegal use of a land plot may include unauthorized occupation of land, use without a lease agreement, unauthorized construction, or placement of чужого property on the land plot.

1. How to Determine the Fact of Illegal Land Use?

Before taking action, it is necessary to collect evidence of illegal use of the land plot. To do this:

  • Verify the existence of title documents for the land plot, such as a state act, lease agreement, or extract from the State Register of Property Rights.
  • Take photographs and video recordings confirming unauthorized use of your land.
  • Interview neighbors or other witnesses who may confirm the illegal use.
  • Order a geodetic survey to confirm the boundaries of the land plot.

2. What Legal Mechanisms Are Available to the Owner?

If you discover that your land plot is being used without your consent, you have the right to:

Contact the Violator

Send an official written demand requiring cessation of illegal use of the land plot.

Contact Law Enforcement Authorities

In cases of unauthorized occupation of land, you may file a complaint with the police pursuant to Article 197-1 of the Criminal Code of Ukraine.

Submit an Application to Local Authorities or the State Service of Ukraine for Geodesy, Cartography and Cadastre

To request an inspection and implementation of appropriate measures.

File a Lawsuit in Court

If the violator refuses to vacate the land voluntarily, you may file a claim in court seeking elimination of obstacles to the use of the land plot pursuant to Article 391 of the Civil Code of Ukraine.

3. What Documents Are Required for Court Proceedings?

If the matter requires court resolution, the following documents should be prepared:

  • Title documents for the land plot.
  • Documents confirming the violation, including photographs, videos, and witness statements.
  • An extract from the State Land Cadastre confirming the plot boundaries.
  • An inspection report prepared by representatives of local authorities or the State Service of Ukraine for Geodesy, Cartography and Cadastre.
  • Responses to applications submitted to the violator or government authorities, if available.

4. Liability for Illegal Land Use

Persons unlawfully using a land plot may be held liable:

Administrative Liability

A fine for unauthorized occupation of land under Article 53-1 of the Code of Ukraine on Administrative Offenses.

Criminal Liability

If damages caused by illegal use are significant, liability is provided under Article 197-1 of the Criminal Code of Ukraine.

Civil Liability

The owner has the right to claim compensation for damages caused by unlawful use of the land plot.
