Illegal Land Seizure: How to Act and Protect Your Rights

Groundless Decisions of Government Authorities or Local Self-Government Bodies

  • Adoption of decisions to change the owner or user of a land plot without legal grounds.

Raider Seizure

  • Forgery of ownership documents.
  • Unauthorized amendments to the State Register of Property Rights to Real Estate without the owner’s knowledge.

2. Action Algorithm in Case of Illegal Land Seizure

Step 1. Collection of Evidence

For effective protection of rights, the owner must collect all documents confirming ownership of the land plot:

  • State act for land ownership or an extract from the State Register of Property Rights to Real Estate.
  • Sale and purchase agreement, gift agreement, or other title documents.
  • Cadastral plan of the land plot.

  • Decisions of authorities that became the basis for land seizure.

Step 2. Filing an Application with Law Enforcement Authorities

  • The Prosecutor’s Office — to initiate verification of unlawful actions by authorities.

Step 3. Administrative Appeal

If the illegal seizure occurred due to decisions of local councils or state authorities, a complaint may be filed with:

  • The authority that adopted the decision.
  • The State Service of Ukraine for Geodesy, Cartography and Cadastre.

Step 4. Judicial Protection

If other mechanisms fail, it is necessary to apply to court. Claims may include:

  • Recognition of ownership rights to the land plot.
  • Recognition of decisions of authorities or local self-government bodies as unlawful.

3. Court Practice in Cases of Illegal Land Seizure

Supreme Court Decision in Case No. 910/13656/20

The owner of a land plot proved in court that the local self-government body had transferred the land to a third party without legal grounds. The court declared the decision unlawful and ordered the return of the land to the owner.

Case No. 640/18197/21

The court declared unlawful the amendments made to the State Register of Property Rights to Real Estate and canceled the registration in favor of another person.

Case No. 910/5097/22

The claimant proved that his land plot had been used by another person without consent. The court ordered the return of the land plot to the lawful owner and compensation for damages.
