Customs fines are a common issue for volunteers, entrepreneurs, and individuals involved in import or export. However, not all fines are lawful — many can be successfully appealed.

The Legal and Real Estate Association of Ukraine has developed a step-by-step process with real-world timelines.

1. Deadlines for Filing a Complaint or Lawsuit

There are two ways to challenge a customs fine:

• Administrative appeal – submitting a complaint to a higher customs authority

• Judicial appeal – filing a lawsuit in an administrative court

Deadlines:

• 10 days – to file an administrative complaint

• 6 months – to file a lawsuit directly if no complaint was submitted

• 3 months – to file a lawsuit after a customs rejection

2. Administrative Appeal: Stages and Timeframes

Submitting a Complaint

• Deadline: within 10 days of receiving the fine

• Required: copy of the ruling, written complaint, supporting evidence

Review by Customs

• Duration: up to 30 days (extendable to 60)

• Customs reviews the documents and decides whether to cancel or uphold the fine

Outcome

• If canceled – case closed

• If rejected – you have 3 months to file a lawsuit

Total duration of administrative appeal: 1–2 months

Note: Customs authorities rarely overturn their own decisions

3. Judicial Appeal: Stages and Duration

Filing a Lawsuit

• Deadline: 3 months after customs rejection, or 6 months from the fine

• Required documents: customs ruling, complaint, evidence, witness statements

Court of First Instance

• Duration: 3–6 months depending on complexity and court load

• The court examines the case and issues a ruling

Appeal Stage (if needed)

• Deadline to file: within 30 days of the initial verdict

• Appeal review: an additional 3–6 months

Total duration of court proceedings: 6–12 months

Courts are often more likely to rule in favor of the complainant if customs violations are well documented

4. Which Path to Choose: Administrative or Judicial

• Administrative appeal – faster (1–2 months), but rarely successful

• Judicial appeal – longer (6–12 months), but with a higher success rate

• Best strategy: start with a complaint to customs → go to court if rejected
