Previously, in the event of family breakdown, children almost always remained in the mother’s custody. However, today the situation has changed. The number of parents independently raising their children is growing. The sense of responsibility and the desire to actively participate in their children’s upbringing is becoming more widespread.
Obtaining the status of a single father is a complex and important step for a parent raising his child alone. This status not only provides legal clarity but also ensures protection and support in difficult situations. To obtain this status, two main conditions must be met:
- Not Being Married: One of the main criteria for obtaining “single parent” status is not being married. This indicates the father’s independence in raising the child.
- Raising and Supporting the Child Independently: The other important condition is the fact of independently raising and supporting the child without the involvement of the other parent or mother. This means the parent must be the primary source of support and upbringing for their child.
The consequences of divorce and the determination of the child’s place of residence with the claimant are not sufficient to confirm “single parent” status, as this does not reflect the actual absence of the mother’s involvement in the child’s upbringing.
Regarding documents that can confirm independent child support without the mother’s involvement, the following can be highlighted:
- Court Decision on Deprivation of Parental Rights: If the mother has been deprived of parental rights, this can serve as proof that the father is independently raising the child.
- Social-Household Commission Act: If an act has been drawn up stating that the father is independently raising the child, this document can be used as evidence.
- Certificate from School (Kindergarten): In some cases, the school or kindergarten can issue a certificate stating that the mother is not involved in the child’s upbringing, which can also confirm independent upbringing by the parent.
