Practice shows that the procedure for registering a marriage in Ukraine is considerably simplified compared to most countries in the world, although it has its peculiarities. Registering a marriage with a foreigner requires collecting necessary documents and consulting with a professional. The procedure for entering into an “international marriage” (a conditional term when the spouses are citizens of different countries) can be standard or expedited. Due to possible threats to life and health during a state of war, Ukraine offers a special accelerated marriage registration procedure, which does not require applying for the “Marriage in a Day” service. This procedure allows for quickly and efficiently registering a marriage in extraordinary circumstances:
- Submitting an application for marriage registration to the RACS department.
- Appointment of the marriage registration date (usually within 2-3 days after the application is submitted).
- Sending a request from the RACS department to the State Migration Service of Ukraine to verify the legality of the foreigner’s stay in Ukraine and obtaining a conclusion.
- Marriage registration and obtaining the marriage certificate.
For this, the following documents are required:
- Passport of the Ukrainian citizen with information about the registered place of residence.
- Tax identification card (or a document confirming the waiver of its issuance).
- Divorce certificate or court decision on divorce (if it is not the first marriage).
The procedure for registering a marriage with a foreigner or between foreigners can be a challenging task due to the need to confirm the foreigner’s legal stay in Ukraine. The issuance of a marriage certificate is requested by the civil registration authority or one of the pilot entities from the territorial migration service.
However, for a person illegally staying in Ukraine, undergoing this procedure is impossible. While this request is an important step, besides time delay, it does not have any other negative consequences for the foreigner. For example, if a foreigner applies to the relevant pilot entity to obtain a marriage certificate within 24 hours, and this entity requests information from the migration service, even if the certificate is ready the next day, it will not be issued without confirmation of the foreigner’s legal stay in Ukraine.
