The topic of migration has always been relevant, especially for foreigners, but current events make it important for many Ukrainians as well. As a direct result of the full-scale conflict, many families are forced to leave their homes and seek refuge abroad. However, this process is extremely complex and involves numerous issues that may be unclear to those who do not have a deeper understanding of constantly changing legal landscape.
The most vulnerable segment of any population is children, and, thus, they require special support. The Lawyers and Realtors Association of Ukraine “AROU” specializes in migration law for children and offers a wide range of services for their protection:
- Obtaining an international passport;
- Assistance with children’s departure abroad;
- Confirmation of children’s citizenship;
- Resolving issues regarding birth certificates;
- Resolving issues regarding archival data;
- Addressing child support matters;
- Representation in court, and more.
Most often, our advocacy association is approached with questions about obtaining permission for a child to travel abroad. This permission is required for children who have not yet reached the age of 16, as, according to the law, a person can only independently leave Ukraine after reaching the age mentioned.
Therefore, a child who has not yet reached 16 years of age can travel abroad only if their parents, adoptive parents, or guardians have provided written consent for this travel and accompany them, or if they travel accompanied by individuals authorized by parents or legal guardians.

In situations where parents are divorced and one of them prevents the child from leaving the country with the other parent, legal proceedings become necessary.
Whether it’s a case where the father refuses to allow the child to leave with the mother, or a situation where the mother refuses, these conflicts can be resolved through the court. The law provides that either parent or even the child themselves, if they have reached the age of 14, have the right to apply to the court with a lawsuit for permission for the temporary departure of a child who has not yet reached the age of 16, or for deprivation of parental rights.
A lawyer specializing in family and migration matters represents clients in court, helping to resolve conflict situations and protect the interests of their clients. This allows finding a solution that takes into account all aspects of the case and ensures sufficient time to address legal issues is employed.
