Due to the complex geopolitical situation and numerous conflicts affecting all corners of the world, the issue of protecting the most vulnerable populations is becoming increasingly relevant. People living in high-risk areas where threats to life, health, and social well-being are ever-present need immediate protection and assistance.
Ukraine, recognized as a destination and transit country for refugees, is taking appropriate measures to ensure international protection for those in need. Current legislation provides a legal mechanism for granting refugee status to individuals in difficult life circumstances who require protection of their rights and freedoms.
A refugee is a person forced to leave their country of origin or residence due to circumstances beyond their control. If there are well-founded fears of persecution and if the individual cannot or does not want to avail themselves of protection from their own country, they have the right to seek asylum in another country. A refugee’s story may be quite ordinary until circumstances arise that force them to seek asylum elsewhere.
To obtain refugee status in Ukraine, the individual or their legal representative must promptly apply to the territorial department (office) of the State Migration Service of Ukraine. This should be done no later than five working days from the date of legal entry into the country. The asylum application must include reasons related to the fear for one’s life if returned to the country of origin, and provide documents confirming the person’s identity and circumstances of persecution.
If the person does not speak or understand the state language, they have the right to use translation services into Ukrainian by involving a translator during the application and review process. The Lawyers and Realtors Association of Ukraine “AROU” offers highly qualified lawyers who can assist with document translation and application writing.
The following documents should be attached to the refugee status application:
- Documents proving the applicant’s identity (passport or other identification confirming citizenship).
- Documents and materials indicating the circumstances justifying the request for refugee status.
- Four photographs of the applicant, and if accompanied by minor family members, an additional four photographs for each person.
These measures help ensure effective processing of the application and recognition of the individual as a refugee in need of international protection.
