Employment issues in Ukraine are quite relevant for foreigners, but job hunting is only one part of the path to legal stay in the country. Obtaining a residence permit is not mandatory in the following cases:
- If the employee mainly works remotely from their country of permanent residence.
- If the employee does not need to stay in Ukraine for more than 90 days within every 180 days.
In these cases, the employee can visit Ukraine (if necessary) with a short-term visa or without a visa, depending on their citizenship.
To apply for a temporary residence permit, the employee must be personally present in Ukraine since their fingerprints are collected on the day of the application’s submission. After the employer obtains a work permit for the employee, three steps must be taken in order to obtain a temporary residence permit:
- Arriving in Ukraine with a special type “D” visa.
- Submitting and obtaining a temporary residence permit in Ukraine.
- Registering the address of residence in Ukraine.
Obtaining this type of residence permit in Ukraine is only possible with a type D-04 visa. To obtain this type, the foreign employee must personally apply for this visa at the Ukrainian embassy in their country of citizenship or permanent residence. The embassy reviews the visa application and decides on granting or denying the visa within 5 days for urgent processing or within 10 days for standard processing from the moment the documents are received.
Additionally, documents issued by competent authorities of a foreign state must be legalized and translated into Ukrainian.
The documents required for obtaining a type D visa include:
- Passport.
- Completed and signed visa application form.
- Color photo.
- Valid medical insurance policy.
- Proof of sufficient financial means for the period of stay.
- Tickets or hotel booking/proof of address in Ukraine.
- Certified copy of the permit for employment of foreigners and stateless persons (work permit).
After the foreign employee arrives in Ukraine with a type D visa, it is important to personally submit documents for the residence permit to the migration service.
