Privatization involves the transfer of an object from state or municipal ownership to private ownership. Today, every citizen has the right to privatize real estate. In the primary real estate market, the privatization of an apartment in Kyiv is an important type of transaction that may require legal assistance.

    Which Properties Can Be Privatized?

If you want to obtain ownership of an apartment, this is certainly the right decision. However, it is not always possible.

You can privatize an apartment in Kyiv if it belongs to the following categories:

    • Single-family homes
    • Residential sections or blocks
    • Residential rooms in dormitories or individual rooms
    • Apartments in multi-unit buildings
    • Houses and apartments used under rental agreements

Exceptions to privatization include museum premises, as well as premises located on closed military territories or enterprise service areas. It is also impossible to privatize housing located in botanical gardens, reserves, parks, the Chernobyl zone, or within military settlements. Dormitory rooms that are in a state of disrepair or located in resettlement zones are also not allowed to be privatized.

What Documents Are Needed and How Does the Privatization Process Work?

The cost of privatizing an apartment will depend on the prices for notary services, as well as the cost of all receipts at BTI (Bureau of Technical Inventory), housing offices (ZhEKs), or Homeowners’ Associations (OSBBs), where you will need to apply.

      1. In the first stage, you need to provide one of the document packages to authorities such as OSBB, ZhEK, or KP:
      • First, you need to write an application for ZhEK or OSMD. All registered adult family members must be present when writing the application. They will need to sign it.
      • ZhEK also issues forms No. 5 and No. 4, which need to be filled out with the details of all registered individuals in the apartment.
      • A certificate of family composition and confirmation that this apartment has not been previously privatized. For this, you will need to contact the privatization department.
      • You will also need a technical passport for the apartment.
      • Copies of passports and tax identification numbers.
      • Birth certificates of children who are also registered in the apartment.
      • You will also need a copy of the occupancy permit and a certificate from the previous place of residence.

If you have any benefits, you need to provide the relevant documents.

      1. In the second stage, you will need to apply to the local state administration with the following documents:
      • Birth certificate (if there is no passport) or passport. This applies to each registered person. If registration was after 1992, certificates from previous places of residence will be required, with information about participation in previous privatizations.
      • Application for the privatization of the apartment in Kyiv with the signature of the ZhEK head.
      • Certificate from Oshchadbank, issued at the place of residence.
      • Technical passport for the housing.
      • Copy of the occupancy permit for the apartment.
      • Form No. 4 from ZhEK.
      • Copies of tax identification numbers.

It is important that an inventory is conducted, on the basis of which a technical passport is issued.

      1. Finally, the last step is applying to the Registration Service, also known as the State Registration Department. It registers the acquired ownership and issues the corresponding certificate. The process usually takes no less than 14 working days from the date of application submission. In addition to the application, the following documents must be submitted again:
      • Application addressed to the Chairman of the Kyiv District State Administration.
      • Certificate (Form No. 4) with data concerning family composition and the area of occupied premises.
      • Document from Oshchadbank confirming that housing vouchers have not been used for privatization.
      • Consent to privatization from family members who may be temporarily absent.
      • Certificate from the previous place of residence for all family members who were registered after 1992 and have not used their right to privatization.
      • Application for the privatization of an apartment or other residential premises, rooms.
      • A copy of the occupancy permit or rental agreement.
      • If applicable, documents for privileges.
      • Technical passport from BTI.
      • Power of attorney for the representative.
      • Passports or birth certificates for minor family members and their copies.

Children cannot independently make decisions about privatization, so parents can confirm their consent with their signatures in the application next to the child’s surname. As we can see, the process is lengthy and labor-intensive, so assistance in privatizing an apartment in Kyiv is essential. Contact a reputable company. We have been working in the real estate market for many years and will help resolve all issues related to privatization. Moreover, our prices for apartment privatization are among the lowest in the capital.
