Enterprises, institutions, and organizations that play a critically important role in maintaining the functioning of the economy during periods of heightened tension and ensuring the livelihood of the population have the right to reserve their employees for deferment from mobilization during martial law.
For an enterprise to obtain this right, a corresponding decision must be issued by:
- a central executive authority;
- another state authority;
- a state governance body whose jurisdiction covers the entire territory of Ukraine;
- a regional state or military administration of the specific administrative–territorial unit where the enterprise is located.
Under current regulations, mobilization deferment may be granted to military-liable employees who work at enterprises, institutions, and organizations that:
- fulfill mobilization tasks (orders);
- produce goods, perform works, or provide services necessary to meet the needs of the Armed Forces of Ukraine and other military formations;
- are critically important for the functioning of the economy and ensuring the livelihood of the population during a special period.
Up to 50% of military-liable employees working at an enterprise at the time of submitting the reservation list may be exempted from mobilization. However, in cases of justified necessity, this number may exceed 50%.
There are no limits on the number of reserved employees for enterprises, institutions, and organizations in the fuel and energy sector; those critically important to the defense and industrial complex; and organizations providing electronic communications services, network access, and related infrastructure.
Reservation from mobilization is an effective and necessary mechanism, as it ensures the proper functioning of critical infrastructure and allows highly qualified specialists to remain in their positions.
