Charitable activity is a very worthy and noble cause. Not everyone can find the strength, time, and opportunity to dedicate themselves to helping others. To legally engage in such a good cause, one needs to have a charitable organization.
A charitable organization is a legal entity operating without the aim of making a profit, to achieve goals specified in its statutory documents.
Charitable organizations exist in Ukraine in three types:
- Charitable Society – An organization created by two or more participants and operating based on its charter. A charitable organization does not necessarily have to own property or raise funds to achieve its goal; it can act in the interests of specific categories of people for social, humanitarian, or other assistance. For example, charitable societies are often created to help military families while their breadwinners are in combat zones away from their families. This assistance does not necessarily have to be financial but can include household help, childcare, etc.
- Charitable Institution – An organization created by one or more participants who transfer assets to the institution to achieve goals specified in its statutory documents. In this case, the distinguishing feature is the transfer of any property by the participants to the institution for statutory activities. For example, this could be real estate on which a shelter, hospital, educational institution, etc., is established.
- Charitable Fund – An organization created by one or more participants to achieve goals specified in its statutory documents. When establishing a fund, participants are not required to transfer any assets for the fund’s existence. The fund’s assets are formed during its existence, as it is often created to organize fundraising. Anyone can contribute to the fund’s activities.

As a general rule, the registration of a charitable organization does not significantly differ from the registration of any other legal entity. The only difference is the need to grant such an organization non-profit status.
After creating a charitable organization, there often arises the need to make changes to the register concerning such an organization. For example, changing the composition of the founders, adding additional assets to the organization, changing its location, and more.
Often, the leadership of the organization manages it during time not occupied by their main job. In such conditions, one does not want to spend precious hours on bureaucratic red tape instead of real deeds and helping those in need. Moreover, the legal aspect of the matter is not always clear to people who do not have sufficient experience and knowledge. Statutory documents are the foundation of any organization, and unqualified interference can cause significant harm. An error in the legal address, non-compliance with the procedure for asset contributions according to current legislation, can be very costly and lead to reputational losses.
