Ukrainian legislation requires obtaining a work permit for all foreign citizens arriving in the country for employment purposes. This permit is issued for a period specified in the contract with the employer or in accordance with the law.
The procedure for obtaining a work permit is clearly defined by Ukrainian legislation. Its duration can range from six months to three years, depending on the circumstances and conditions provided by law. After obtaining a work permit, a foreign citizen receives a temporary residence permit in Ukraine.
However, situations may arise where the residence permit is canceled due to the cancellation of the work permit.
What are the grounds for canceling a work permit?
The relevant government authority that made the decision regarding the issuance of the work permit is obligated to provide the employer company with the permit for the employment of the specified foreign employee within several working days. After receiving the decision, the employer company has 10 days to pay the relevant fees for the issuance of the work permit. If payment is not made within this period, the permit will be revoked.
Within 10 calendar days from the signing of the employment contract between the employer company and the foreign employee, the former must provide a certified copy of the signed employment contract to the state authority. Failure to submit such a contract is grounds for canceling the work permit.
If the employment contract is not signed within 90 calendar days from the date of obtaining the work permit, this also constitutes grounds for canceling the work permit.
It should be noted that the cancellation of the work permit does not mean the cancellation of the residence permit. However, if the work permit of a foreign citizen is revoked, the duration of the residence permit cannot be extended.
